Legal Basis for Academic Adjustments in Studies

The right to reasonable accommodations for students with disabilities and chronic illnesses is enshrined in numerous legal provisions.

(Constitution) Articles 3 and 20
The right to reasonable accommodations for people with disabilities, including in higher education, is derived from Articles 3 and 20 of the German Basic Law (Grundgesetz). These articles establish the principle of equality, the prohibition of discrimination against individuals with disabilities, and the social state principle.

"All persons are equal before the law. No person may be disadvantaged because of their disability." (Article 3, Basic Law)

"The Federal Republic of Germany is a democratic and social federal state." (Article 20, Basic Law)

The Higher Education Framework Act stipulates that state and state-recognized universities must consider the needs of students with disabilities as part of their core responsibilities. The right to modified study and examination conditions is also explicitly anchored in the law.

"Universities contribute to the social support of students; (...). They ensure that students with disabilities are not disadvantaged in their studies and that they can access university services as independently as possible." (§ 2 (4) HRG)

"Examination regulations must take into account the specific needs of students with disabilities to ensure equal opportunities." (§ 16 Sentence 4 HRG)

State Higher Education Laws for Rhineland-Palatinate
The provisions of the Higher Education Framework Act (HRG) have been incorporated into state legislation, often using identical wording. Both the HRG and the state higher education laws specify that examination regulations must include measures to address the needs of students with disabilities and chronic illnesses (HochSchG RLP §2 (4) and §26 (4)).

Additionally, other regulations or statutes of the university may contain relevant provisions regarding reasonable accommodations.

State Regulations: Reasonable Accommodations and Appropriate Measures in Higher Education

General Examination Regulations of Kaiserslautern University of Applied Sciences

The provision for reasonable accommodations is outlined in both the General Bachelor's and Master's Examination Regulations of Kaiserslautern University of Applied Sciences in (§6) as follows:

"(7) Students with disabilities or chronic illnesses must be granted appropriate reasonable accommodations to ensure equal opportunities. If students provide credible evidence that they are unable to complete examinations or coursework fully or partially within the specified timeframe or in the prescribed format due to a prolonged or permanent disability or illness, the Examination Committee must grant accommodations upon written request. Examples include extending the processing time or permitting the use of appropriate aids. The submission of a medical certificate or other suitable documentation may be required."
